  10. LICENSE AGREEMENT AND WARRANTY DISCLAIMER

  12. You should carefully read the following terms and conditions before
  13. using this software. Use of this software indicates your acceptance
  14. of these terms and conditions. If you do not agree with them, do not
  15. use the software.

  18. SHAREWARE VERSION LICENSE
  19.  
  20. The Shareware Version is not free software. If you are using the
  21. Shareware Version you are hereby licensed to use this software for
  22. evaluation purposes without charge for a period of 30 days. If you
  23. use this software after the 30 day evaluation period a registration
  24. fee is due (see Ordering Information).

  26. If you are using the Shareware Version of the software you are also
  27. hereby licensed to: Make as many copies of the Shareware version of
  28. this software and documentation as you wish; Give exact copies of
  29. the original Shareware version to anyone; Distribute the Shareware
  30. version of the software and documentation in its unmodified form via
  31. electronic means. There is no charge for any of the above.

  33. Unregistered use of Folder Synchronize after the 30-day evaluation
  34. period is in violation of federal copyright laws.

  36. You may not decompile, disassemble, or reverse engineer Folder
  37. Synchronize (shareware) in any manner.

  40. REGISTERED VERSION LICENSE

  42. One registered copy of Folder Synchronize may be dedicated to a
  43. single person who uses the software on one or more computers or
  44. workstations that are for their own exclusive use and for which
  45. they are the sole user.

  47. A single user license may be used to process as many files on as
  48. many drives or network shares as you like.  However, a single user
  49. license registration may not be made available in any form to
  50. multiple users or workstations.

  52. Licensing is not based on "concurrent" users.  If multiple
  53. workstations are to access the program in any form and for any
  54. length of time you must purchase licenses for the number of users
  55. that will access the program.  If you make the registered version
  56. of Folder Synchronize available through a network and accessible
  57. by multiple users or workstations you are required to purchase
  58. licenses for the software covering all workstations that will
  59. access the software through the network.  Special pricing is
  60. available for multiple licenses.  See Ordering Information for
  61. information on how to purchase (register).

  64. WORKSTATION UPDATE AND/OR SPECIAL USE LICENSE

  66. Special licensing (and pricing) is available for modifying or
  67. searching multiple workstations, directly or indirectly, via
  68. scripts, command line processing, or logon routines.  The purchase
  69. of a special use license allows you to use the program to update
  70. the number of workstations for which you purchased special use
  71. licenses for.  Unless otherwise noted at the time of your
  72. purchase, a workstation update/special use license specifically
  73. does not allow individual workstation users to access the program
  74. for interactive use.  Do not create desktop shortcuts or launchers
  75. that allow workstation users to access the program outside of the
  76. specific update routine for which you purchased the special use
  77. license.

  83. OWNERSHIP RIGHTS

  85. Funduc Software, Inc. owns and retains all copyrights, patents,
  86. trade secret rights, trademarks and intellectual property rights
  87. to this software. Registration &/or use of the software does not
  88. grant you any right to the intellectual property in the product.

  99. You are prohibited by law from selling, renting, leasing, loaning,
  100. or donating the program or documentation in whole or in part
  101. without specific advance agreement between yourself and Funduc
  102. Software, Inc.  You are prohibited by law from redistributing the
  103. registered version of the program by any method or in any form
  104. except to the specific individuals for whom the software was
  105. purchased.  You are prohibited from decompiling, reverse
  106. engineering, disassembling, or otherwise reducing the program to
  107. human readable form for any purposes whatsoever.  You may not
  108. modify the program or documentation in any manner.  You are
  109. prohibited from permitting anyone else from undertaking any of the
  110. above actions.

  113. Folder Synchronize (registered or shareware) in any manner.

  116. GOVERNING LAW

  118. This agreement shall be governed by the laws of the State of
  119. Michigan, United States.

  122. DISCLAIMER OF WARRANTY

  124. This software and the accompanying files are sold "as is" and
  125. without warranties as to performance of merchantability or any
  126. other warranties whether expressed or implied.  In particular,
  127. there is no warranty for the string Replacing feature.

  129. Good data processing procedure dictates that any program be
  130. thoroughly tested with non-critical data before relying on it.
  131. The user must assume the entire risk of using the program. Any
  132. liability of the seller will be limited exclusively to product
  133. replacement or refund of purchase price.
